South Korea prevails as ICSID annulment committee closes six-year, USD 190 million investor-state dispute
An ICSID ad hoc committee has rejected Chinese investor Fengzhen Min's bid to annul the May 2024 tribunal award dismissing his investment treaty claim against South Korea, arising from a defaulted loan and the enforcement of pledged shares. The committee upheld the tribunal's finding that Min's underlying investment was unlawful and therefore outside the Korea-China BIT's protection, ordering him to cover South Korea's legal costs plus annulment expenses.
