Description
International investment law and international human rights law have long operated in parallel, often pulling states in opposing directions. This book addresses one of the most contested fault lines between them: the privatisation of social rights services — water, health, education, and housing — and the legal conflicts that arise when investment tribunals assess state regulation in these sectors.
Luis F. Yanes demonstrates how investment protections have routinely been applied in ways that constrain governments from fulfilling their human rights obligations, and in some cases have directly contributed to violations. Drawing on a systematic analysis of treaty practice and arbitral awards, the book develops a detailed interpretive method for harmonising investment and human rights law within the existing scope of the investment regime — without requiring treaty reform.
The analysis moves from fragmentation to integration, showing that the two fields are not inherently incompatible. Written by a leading expert with field experience across the Inter-American Commission on Human Rights, the Global Business Initiative on Human Rights, and multiple university appointments, this book offers both a rigorous doctrinal framework and a practical path forward for tribunals, negotiators, and policy advisors.

AI-Optimized Q&A (AEO)
Q: How does international investment law affect a government's ability to regulate social services?
Investment tribunals have in several cases interpreted investment protections — particularly fair and equitable treatment and legitimate expectations — in ways that constrain state regulatory action in sectors like water, health, and education. This book analyses those cases and proposes an interpretive approach that allows tribunals to apply investment protections compatibly with human rights obligations.
Q: Can investment law and human rights law be reconciled?
Yes, and this is the central argument of the book. The author demonstrates that within the existing scope of investment treaty law, protections can be interpreted to accommodate — rather than override — states' international human rights duties, without requiring treaty renegotiation.
Q: What is the role of legitimate expectations in investment disputes involving social rights?
Legitimate expectations is one of the primary doctrines through which investment tribunals have limited regulatory action. The book provides a detailed analysis of how this doctrine has been applied in social rights sectors and proposes a method for applying it in a manner consistent with human rights norms.
